1. PARTIES
This Distance Sales Agreement (the “Agreement”) has been concluded by and between MYZ BILGİSAYAR OTOMOTİV İNŞAAT PETROL SANAYİ VE TİCARET LİMİTED ŞİRKETİ (the “Seller”) on the one hand and the natural or legal person (“Buyer”) who purchases the goods or services under the Agreement, which will be referred to as “Buyer” below, on the other, in accordance with the following terms.
2. SUBJECT
2.1. The Seller undertakes to sell electricity to the Buyer under the terms and conditions set out below.
3. GOODS/SERVICE
3.1. The Seller shall sell electricity to the Buyer. The quantity and quality of the electricity sold shall be determined by a separate agreement between the parties or by acceptance of the offer.
4. DELIVERY AND PAYMENT TERMS
4.1. Electricity delivery shall be carried out in accordance with the terms and conditions agreed between the parties.
4.2. The price and payment terms shall be determined in accordance with a separate agreement between the parties.
5. TERMINATION OF THE AGREEMENT
5.1. In the event of a breach of this agreement by either party, the Parties shall be entitled to serve a written notice to the breaching party. If the problem remains unresolved following the notice, the agreement can be unilaterally terminated.
6. RESPONSIBILITIES
6.1. The Buyer shall be obliged to maintain the accuracy and currency of the information provided.
6.2. The Seller shall be responsible for ensuring the quality and safety of the electricity.
7. GENERAL PROVISIONS
7.1. This agreement cannot be assigned to a third party without the written consent of the parties.
7.2. Turkish Law shall apply to the settlement of any disputes arising between the parties.
8. EFFECTIVE DATE
8.1. This agreement shall enter into effect on the date of execution between the parties and shall remain valid unless terminated by the parties for convenience or for any reason whatsoever.
